CCCI convicts 16 insurgents
One sentenced to death, three sentenced to 20 years

BAGHDAD, Iraq
— The Central Criminal Court of Iraq convicted 16 security detainees from December 1 to 7, for various crimes including illegal possession of special category weapons, violation of the terrorist laws, failure to renew resident identification and illegal border crossing.

The trial court found a Libyan man guilty of violating Article 4/1 of the Terrorist Law.  The defendant was captured during a targeted raid and admitted to participating in eight separate attacks against Multi-National Forces and Iraqi security targets, including small arms fire, RPG and missile attacks.  He also admitted to being a member of the Al-Qaeda in Iraq organization.  On Dec. 6 the trial panel considered all the evidence and sentenced him to death.

The trial court found three Iraqi men guilty of illegal possession of special category weapons in violation of Coalition Provisional Authority Order 3/2003.  Multi-National Forces apprehended the defendants after spotting an IED on the road in front of a convoy.  A search of the defendant’s vehicle revealed one hand grenade, one 9mm pistol and ammunition, three video cameras, one phone, two base station phones and other IED making materials.  On Dec. 3 the trial panel considered all the evidence and sentenced them to 20 years imprisonment.  

The trial court found an Iraqi man guilty of illegal possession of special category weapons in violation of Order3/2003. MNF apprehended the defendant after stopping to inspect a suspected IED in Fallujah.  The defendant’s vehicle also stopped on the roadway next to the convoy.  A search of the vehicle revealed 25 M6 artillery fuses, three 82mm mortar fuses, one 120mm mortar round, four 82mm mortars, 13 130mm artillery rounds and two 155mm artillery rounds.  On Dec. 3 the trial panel considered all the evidence and sentenced him to 15 years imprisonment.

The trial court found three Iraqi men guilty of illegal possession of special category weapons in violation of Order3/2003. Iraqi Police apprehended the defendant after stopping a suspicious vehicle.  After stopping, the defendants fought with the IP, attempting to get the IP’s weapons.  A search of the vehicle revealed three 155mm artillery shells rigged as IEDs and a timer and cell phone rigged for detonation in the trunk of the vehicle.  On Dec. 4 the trial panel considered all the evidence and sentenced the three to 15 years imprisonment.

Those convicted of passport violations, illegal possession of special category weapons and failure to renew resident identification, were sentenced from between one year to 15 years imprisonment.  Those convicted included four Iraqis and two each from Saudi Arabia and Syria.

Since its reorganization, under an amendment to CPA order 13, in April 2004, the Central Criminal Court has held 1,767 trials for Coalition-apprehended insurgents.  The proceedings have resulted in the conviction of 1,521 individuals with sentences ranging up to death.
